Customer Terms of Service
Effective Date: August 29, 2026
These Customer Terms of Service (“Terms”) govern the purchase and use of services provided under the Stability LeadGen name (“Stability,” “we,” “us,” or “our”).
By purchasing, activating, or using Stability’s services, you (“Customer,” “you,” or “your”) agree to these Terms.
1. Stability Services
Stability provides AI-powered virtual receptionist and related business communication services designed to assist businesses with inbound customer communications.
Depending on the Customer’s configuration, services may include answering inbound calls, responding to common questions, collecting caller and lead information, assisting with appointment scheduling, routing calls or follow-up requests, documenting interactions, and performing other configured receptionist functions.
Features and functionality may vary based on the Customer’s selected configuration, third-party systems, telephone setup, scheduling systems, and other technical requirements.
2. AI-Powered Service
Customer acknowledges that Stability uses artificial intelligence to provide portions of the service.
AI-generated conversations and responses may occasionally contain errors, misunderstand callers, incorrectly transcribe information, or provide an unintended response. Stability does not represent or warrant that the AI receptionist will be error-free or perform identically to a human receptionist.
Stability configures the service using information and instructions supplied or approved by Customer. Customer is responsible for reviewing the configuration and promptly notifying Stability of inaccurate, outdated, or inappropriate information.
Stability may modify prompts, configurations, workflows, or technical settings when reasonably necessary to improve performance, reliability, safety, or functionality.
3. Customer Responsibilities
Customer agrees to provide accurate and reasonably complete information necessary to configure and operate the service, including applicable business information, services offered, service areas, hours, scheduling procedures, escalation instructions, pricing information authorized for disclosure, and other operating rules.
Customer is responsible for notifying Stability when this information changes.
Customer is also responsible for maintaining any telephone forwarding, calendars, accounts, integrations, permissions, or third-party services required for the Customer’s configuration.
Stability is not responsible for errors or service issues resulting from inaccurate Customer information, Customer configuration decisions, unavailable integrations, or Customer-controlled systems.
4. Activation and Setup
Stability will generally make the Customer’s service live within up to 48 hours after Stability has received all information, access, approvals, and other materials reasonably required to complete setup.
The activation period does not begin until those requirements have been received.
Additional time may be required when setup depends upon third-party providers, telephone carriers, integrations, account approvals, technical issues, or Customer-requested customization.
5. Fees and Recurring Billing
The Stability AI Receptionist service is currently offered at $297 per month, unless another price is stated in the Customer’s order or payment arrangement.
By purchasing a recurring subscription, Customer authorizes Stability and its payment processor to automatically charge the payment method provided for the applicable subscription fee on each recurring billing date until the subscription is canceled.
Customer is responsible for maintaining a valid payment method.
Stability may change pricing for future billing periods by providing reasonable advance notice. A price change will not retroactively affect a billing period that has already been paid.
Applicable taxes, if any, may be added where required by law.
6. Cancellation, Refunds, and Billing Periods
Subscriptions are month-to-month unless otherwise agreed in writing.
Customer may cancel at any time before the next renewal.
Cancellation prevents the next recurring subscription charge but does not terminate the Customer’s already-paid service period. Service will ordinarily remain available through the end of the current paid billing period.
Payments are non-refundable and are not prorated for partial billing periods, except where otherwise required by law or expressly agreed to by Stability.
7. Optional Trial
Stability may, at its discretion, offer a prospective Customer a limited free trial.
Unless otherwise stated in writing, a trial begins when the Customer’s AI receptionist is activated and made available for live use—not when discovery, configuration, or setup begins.
Trials are intended for qualified prospective Customers and may be limited to one trial per business.
A free trial does not automatically create a paid subscription unless the Customer separately authorizes paid service.
Stability may modify, decline, or discontinue a trial offer at its discretion.
8. Telephone, Call Forwarding, and Third-Party Services
Stability relies on third-party technology and service providers, which may include telecommunications carriers, cloud infrastructure, artificial intelligence providers, CRM platforms, payment processors, scheduling systems, and other integrations.
Stability does not control these third-party systems and cannot guarantee their continuous availability or performance.
Service may occasionally be interrupted or degraded because of carrier failures, internet outages, platform outages, integration failures, maintenance, changes made by third-party providers, or other circumstances outside Stability’s reasonable control.
Customer acknowledges that Stability is not an emergency communications service and should not be used as a substitute for 911 or other emergency services.
9. Calls, Recordings, Transcriptions, and Communications Compliance
Depending on the Customer’s configuration and applicable technology, calls may be processed, transcribed, summarized, analyzed, or recorded using automated systems.
Customer is responsible for ensuring that its use of Stability complies with laws and regulations applicable to its business and communications, including any requirements concerning call recording, monitoring, consent, disclosures, telephone communications, text messaging, and marketing communications.
Stability may provide tools or configuration options intended to assist with compliance, but Customer remains responsible for determining the legal requirements applicable to its business and use of the service.
10. Customer Data
As between Stability and Customer, Customer retains ownership of Customer-specific business information and data supplied by Customer or collected on Customer’s behalf through the service, subject to the rights necessary for Stability to provide and support the service.
Customer authorizes Stability and its service providers to process Customer data as reasonably necessary to provide, maintain, secure, troubleshoot, and improve the Customer’s service.

11. Stability Technology and Intellectual Property
Stability retains all rights in its technology, systems, prompts, workflows, templates, processes, configurations, software, documentation, methodologies, branding, and other intellectual property developed or owned by Stability.
Customer receives a limited, non-exclusive, non-transferable right to use the Stability service during an active subscription.
Customer may not copy, reverse engineer, reproduce, resell, sublicense, or commercially exploit Stability’s proprietary systems or materials except with Stability’s written permission.
12. Acceptable Use
Customer may not use Stability’s services for unlawful, fraudulent, deceptive, abusive, threatening, harassing, or otherwise prohibited activities.
Customer may not use the service to violate another person’s rights or applicable communications, privacy, consumer-protection, or marketing laws.
Stability may suspend or terminate service when Stability reasonably believes continued use creates legal, security, fraud, abuse, platform, or reputational risk.
13. No Guarantee of Business Results
Stability is designed to help businesses manage communications and opportunities more effectively.
Stability does not guarantee any particular number of leads, appointments, customers, sales, revenue, conversion rate, response rate, or other business result.
Customer remains responsible for its sales process, customer service, fulfillment, business decisions, and follow-up activities.
14. Disclaimer of Warranties
To the maximum extent permitted by law, Stability’s services are provided “as is” and “as available.”
Stability disclaims warranties not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and uninterrupted or error-free operation.
Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
15. Limitation of Liability
To the maximum extent permitted by law, Stability will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost business opportunities, lost revenue, or loss of data arising from or related to the service.
To the maximum extent permitted by law, Stability’s aggregate liability arising from or relating to the service will not exceed the amount actually paid by Customer to Stability during the three months immediately preceding the event giving rise to the claim.
These limitations apply regardless of the legal theory asserted, except where liability cannot lawfully be limited.
16. Indemnification
Customer agrees to defend, indemnify, and hold harmless Stability and its owners, personnel, contractors, and affiliates from third-party claims, damages, liabilities, costs, and reasonable expenses arising from Customer’s unlawful use of the service, Customer-provided information or instructions, Customer’s business operations, or Customer’s violation of these Terms or applicable law.
17. Suspension and Termination
Stability may suspend service for nonpayment, misuse, security concerns, legal or regulatory requirements, third-party platform restrictions, or material violation of these Terms.
Either party may terminate the month-to-month service in accordance with the cancellation provisions above.
Upon termination or expiration, Customer’s right to use the service ends. Stability may retain information as reasonably necessary for legal, accounting, security, backup, fraud-prevention, or other legitimate business purposes and as described in the Privacy Policy.
18. Changes to the Service or Terms
Stability may modify or improve its service over time.
Stability may also update these Terms. If a change materially affects an active Customer’s rights or obligations, Stability will provide reasonable notice where appropriate.
Continued use of the service after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.
19. Governing Law
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles.
Any dispute arising from these Terms or Stability’s services will be subject to the jurisdiction and venue of the appropriate state or federal courts located in Arizona, unless the parties separately agree to another dispute-resolution procedure.
20. Entire Agreement
These Terms, together with the applicable order, payment terms, Privacy Policy, and any written service-specific terms agreed between Stability and Customer, constitute the agreement concerning Customer’s use of the service and supersede prior discussions or representations concerning that subject.
If Customer and Stability enter into a separately signed written agreement that conflicts with these Terms, the signed agreement controls to the extent of the conflict.
